§1 Applicability to entrepreneurs and definition of terms
The following General Terms and Conditions apply to all deliveries between Frank Ebert and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity (§ 13 BGB).

§2 Conclusion of a contract, storage of the text of the contract

(3) The presentation of the goods in the internet shop of "The Cosmic Elements Verlag" does not constitute a legally binding offer of contract, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in the Internet shop, the following provisions shall apply: The consumer makes a binding offer to enter into a contract by successfully completing the order procedure provided in the internet shop of "The Cosmic Elements Verlag".

The order is placed in the following steps:

1) Selection of the desired goods
2) Checking the details in the shopping basket
3) Pressing the "checkout" button
4) Login to the Internet shop after registering and entering the login details (e-mail address and password). Or order without registration
5) Checking or correcting the data entered and checking the information on the right of withdrawal, data protection and the General Terms and Conditions.
6) Confirmation of the information on data storage, the General Terms and Conditions as well as confirmation of the waiver of the right of withdrawal for download products.
7) Binding submission of the order by clicking the "Buy now" button.

Before the binding submission of the order, the consumer can, by pressing the "back" button contained in the Internet browser used by him, after checking his details, return to the Internet page on which the customer's details are recorded. Likewise, by clicking the "Show shopping basket" button again, the consumer is returned to the shopping basket in order to correct entries or make other changes for the order. By closing the Internet browser, the entire ordering process is cancelled.
Immediately after receipt of the order, the consumer receives an automatically generated e-mail ("order confirmation"). With this e-mail, the customer's offer is accepted.

(5) Storage of the contract text for orders via the internet shop of "The Cosmic Elements Verlag":
The text of the contract and the order data shall be stored and sent to the Customer by e-mail together with the GTC and the cancellation policy. The GTC can also be viewed at any time at In the customer area under "My account" --> My orders, the consumer has insight into all past orders.

§3 Prices, shipping costs, payment, due date
(1) The prices stated include the statutory value added tax.

(2) There are no shipping costs.

(3) Payment shall be made after receipt of the invoice via the advance payment method.

(4) The invoice amount is to be paid within 14 days to the specified account of Frank Ebert. If no receipt of payment is registered within this payment period, the contract expires with immediate effect. The consumer then has the possibility to order the product again via the internet shop.

§4 Delivery
Unless clearly stated otherwise in the product description, all items offered are ready for immediate dispatch. Delivery is made directly after receipt of payment via a download link. In case of repeated failure of the transmission due to e.g. a bad internet connection, the files can be sent by e-mail.

§5 Right of withdrawal
The consumer can no longer revoke an order once he has received the download link of the product. The download link will only be sent after receipt of payment. However, if no receipt of payment is registered within 14 days after the binding dispatch of the order, the order as well as the contract shall expire with immediate effect.

§6 Registration and cancellation regulations for workshops/seminars
The registration and reservation of a participant place for a workshop takes place via the internet shop The obligation to pay arises upon conclusion of the contract through the binding order of the offer via the shopping basket. The seminar fee must be paid no later than 14 days after the invoicing and will be confirmed in writing after receipt of payment. If no receipt of payment is registered after 14 days, the contract expires with immediate effect. In case of written cancellation, 4 weeks before the first seminar day, the seminar fee already paid will be cancelled and fully refunded. After expiry of the 4-week period before the start of the seminar, no refund of the seminar fee is possible. After expiry of the 4-week period, the participant has the option of transferring the already reserved participant place to another person in consultation with the seminar leader Frank Ebert.

§7 Copyright
All content and products created on the website are protected by copyright. Duplication, processing, distribution and any kind of exploitation outside the limits of copyright require the written consent of the author: Frank Ebert.

§8 Right of use for music
With the purchase of a music licence, the customer receives the rights of use and performance of a piece of music protected by copyright. As proof of the acquired rights of use vis-à-vis a collecting society, such as GEMA, the customer also receives a release document. The author, Frank Ebert, remains the owner of the piece of music.
